All registered users of www.eis-perfecto.de declare that they agree that Movito Andreas Thomä may use the data and files (images, recipes and texts, etc.) made available by them in the recipe portal or elsewhere even after their own use of the www.eis-perfecto.de may also be electronically reproduced by Movito Andreas Thomä itself or by third parties named by Movito Andreas Thomä for the purposes of portal operation and made available for download (§ 19 UrhG). The user also agrees that all submitted content cannot be deleted without the consent of Movito Andreas Thomä. In addition, Movito Andreas Thomä may use the contents of its newsletter projects from www.movito.fit and www.eis-perfecto.de by mail to others Users and allow third parties to access the content and offer it for download on their website.
The user confirms and gives us permission to use and publish the data and files they have set and made available, as explained above.
If the user is not sure about the copyright situation, the content may not be uploaded and posted in case of doubt. Especially when the user cannot clearly judge the copyright situation in his and our favor.
If an electronic reproduction or distribution or the making available by us in accordance with § 19a UrhG with regard to content that a user has uploaded or that has been made available to us by a user leads to legitimate injunctive relief and claims for damages from third parties the user is obliged to release the company Movito Andreas Thomä and its legal representatives immediately from these claims and to assume the costs of extrajudicial and any judicial legal defense. This applies in particular in those cases in which the user culpably failed to inform us of usage restrictions or discontinued the content, although he knew or could have known that there were conflicting rights of third parties.
Particular caution is required, especially when uploading photographs and other image material that does not originate from the user himself. This material should be expressly marked as in the public domain. If an author or photographer is specified in connection with the use, we must be informed in advance by email, stating the source.
Claims for damages against Movito Andreas Thomä can only be asserted if we have culpably violated our essential contractual obligations. If we are only at fault or if only insignificant secondary obligations are violated, we exclude any liability on our part, whereby claims under the Product Liability Act remain unaffected. In terms of amount, all possible claims for damages by our users against us are limited to the foreseeable damage. This does not apply to claims under the Product Liability Act or to injury to life, limb and health.
